A client recently visited the offices of Trust Mediation to inquire about a divorce. The client's main concern was that she wanted to finalize a divorce in the United States, but she didn't know if it was possible because her spouse lives in South America. The client had been to four attorneys before making her appointment with Trust Mediation and each either (1) quoted her an unreasonable fee or (2) told her it could not be done. The client's question is one that is very common when filing for divorce because the initiating spouse has to be able to serve (deliver to) the second spouse a complaint by an acceptable means of exchange (for example personal delivery, mail, sheriff, process server) to assert personal jurisdiction. |

Es mucho lo que se ha dicho en el curso de la interminable elecciones presidenciales de 2012. Algunas cosas valen la pena escuchar, otras cosas no.
Mi negocio no es apoyar a lo político. Pero por desgracia, estoy, como muchos de ustedes expuesto al constante bombardeo de anuncios ridículos en la televisión con temas politicos.
Recuerda cuando la televisión era una forma de entretenimiento, no sólo una empresa comercial gigante? Triste no? Sin embargo, me doy cuenta, a través de estos comerciales, que tienden a encontrar problemas que tenemos en común con los demás y me gustaría compartir uno de esos momentos con todos ustedes. |

There is much that has been said during the course of the seemingly endless 2012 presidential election. Some things are worth listening to, many things not so much. I do not make it my business to get political. Unfortunately, I am, like many of you exposed to the constant bombardment of ridiculous advertisements paid for by Super Pacs on television. Remember when television was a form of entertainment, not just one giant commercial enterprise? Sad really. However, I am noticing that through these commercials we tend to find issues we have in common with each other and I would like to share one of those moments with all of you. |

Every so often someone asks me "how did you get into divorce mediation?" The answer is simple. "I hate what conflict does to people." Take, for example, what happened as a result of the Aurora, Colorado movie theater shooting at the Batman premier this past Friday. Some "lone wolf" kid, who is almost certain to be diagnosed with a mental health disease, shoots seventy people. Bam! The media have a story. Of course, CNN one of the many networks reporting the story took 24 hours to talk about the victims of this senseless crime. |

Hey did you hear the news? CNN announced a few days ago that actors Tom Cruise and Katie Holmes split up! Let's hope their report is accurate this time. Oh well, maybe you don't care so much, maybe you were dealing with some of life's more pressing issues like power outages and floods that are plaguing the nation and generally make it difficult for you to watch CNN. Indeed, if you are like most of us, you say "who cares, just another rich Hollywood star divorces, big deal, they get everything they want anyway, they have the money. |

Tragedy has been no stranger to the Kennedy family. Some say the family is plagued by an evil curse. Assassination, sporting accidents, drug addiction, depression, plane accidents, and love affairs have all managed to claim lives in the Kennedy household for the past three decades. However, after reading Newsweek's latest article entitled, "The Last Days of Mary Kennedy" published on June 18, 2012, I think its time we add divorce to the Kennedy list. Specifically, litigated divorce. |

Yesterday afternoon the news announced that the Bergen County Courts would not be hearing any family court cases. To the best of my knowledge, there seems to be a dispute among legislators and/or judges regarding family court cases. I imagine it must have something to do with the volume of cases that clog up the dockets. The bottom line is that the courts cannot handle the number of cases that are scheduled for the judges to hear on a daily basis. New Jersey has been good about promoting the alternative of mediation to resolve family court cases and tries very hard to encourage parties to attempt to mediate their dispute because they know the truth. |

On Christmas morning, a week ago, the Stamford, Connecticut police department received a tragic phone call to a three alarm fire at the home of fashion consultant and advertisement executive Madonna Badger. Police and fire crews were dispatched to the home but the fire ultimately took the life of Ms. Badger's three children and their grandparents. Lily Badger was ten years old and the twins Sarah and Grace were seven year old. A subsequent investigation determined that the children had discarded hot embers from the home's fireplace to keep Santa from burning himself when he would come sliding down the chimney that night. |

This week I was informed of a very sad situation that I believe I should use as a hypothetical scenario to educate the public on the perils of seeking to dissolve a marriage by hiring a private attorney. I will avoid using the actual names of the parties involved to protect their privacy and preserve colleague relationships. The following events are based on a real case where a couple seeking a divorce decided to hire independent lawyers to litigate rather than mediate their divorce. |

If anyone out there caught the last installment of the Today Show, you may be aware of the famous "Psycho Ex-Wife Blog". The blog, once found at www.thepsychoexwife.com, was ordered shut down by a family court judge. The disgruntled exhusband who posted the blog as a way to work out his anger is claiming that the ruling violates his First Amendment Rights. Of course, the Today Show, in its thirst for ratings focused on the exhusband's anger and the assumed borderline personality disorder of the exwife. |
